    If you work for the Government, you may be eligible for compensation for certain legal expenses. You can also receive compensation for expenses from a pretrial investigation or other expenses which are considered necessary.

  • Preconditions for receiving compensation

    Compensation can be paid when:

    * You have been accused of or required to compensate for incorrect procedure in the administration of an office or work
    AND
    * processing the matter ended in the pretrial or consideration of charges phase without a court solution or
    * the charges were dismissed in court.

  • What to do

    Apply for compensation for legal and pretrial investigation expenses from the State Treasury by filing an application form.

    If your application is based on a court judgement on the compensation of legal expenses, attach a copy of the court decision to your application.

    If you are applying for compensation for pretrial investigation expenses, the following items must be attached to your application:
    * a non-prosecution decision or similar report (e.g. notification of the completion of the investigation) and
    * declaration of the expenses.

    When the State Treasury pays compensation to an offender, the collection right is transferred to the State Treasury from the body originally responsible for payment.

    If the other conditions for receiving compensation are met, compensation for necessary legal expenses can be paid even when the compensation is not defined in the sentence. This requires that the payment of the compensation is reasonable, considering the position of the applicant and the other circumstances. In this case, the application must justify why the compensation should be paid, and a copy of the court decision must be attached.
